Terms of Service

These Terms are the agreement between you and the PokeRoamers team for using PokeRoamers at pokeroamers.com. Please read them together with the Player Rules and the Privacy Policy. Questions are welcome at legal@pokeroamers.com.

1. About PokeRoamers

PokeRoamers is an unofficial fan project: a multiplayer Pokémon-style adventure that runs in your web browser. It is run by a small group of volunteers, referred to in these Terms as “the PokeRoamers team”, “we” or “us”. “You” means the person using PokeRoamers, and “the game” means the website, the game client and servers, and everything connected to them.

PokeRoamers is free and non-commercial. There are no payments, no subscriptions, no advertisements and no premium currency, and we do not make money from it.

2. Accepting these Terms

• When you create an account you are asked to tick a box confirming that you accept these Terms, the Player Rules and the Privacy Policy. You cannot create an account without doing so.
• We keep a record of which version of the Terms you accepted and when.
• By continuing to use the game you remain bound by the version of the Terms you have accepted. When we change the Terms in a material way, we ask you to accept the new version the next time you sign in (see section 15).
• If you are between 13 and 17 years old, a parent or legal guardian must accept these Terms on your behalf (see section 3).
• If you do not agree with these Terms, please do not create an account or use the game.

3. Who can play

• You may play if you are 18 or older.
• If you are 13 to 17, you may play only with the permission of a parent or legal guardian. That person accepts these Terms on your behalf and is responsible for your account and how it is used.
• Children under 13 may not create an account or play.
• If we learn that a child under 13 has an account, we delete it. Parents and guardians can contact us at legal@pokeroamers.com about a child’s account.

4. Not affiliated with Nintendo

PokeRoamers is not affiliated with, endorsed, sponsored or approved by Nintendo, Creatures Inc., GAME FREAK inc. or The Pokémon Company. Pokémon and all related names, characters and marks are trademarks of their respective owners, and all rights in them belong to those owners. Nothing in the game or in these Terms grants you or us any right in that material.

The PokeRoamers website does not distribute Nintendo game data. The graphics and sounds you see and hear in the game are built inside your own browser from ROM files you provide (see section 5).

5. Your ROMs

• To play, you select your own ROM files (dumps) of the game cartridges the game uses. You may only use dumps of cartridges that you legally own.
• You must not use pirated or downloaded dumps, and you must not share ROM files with anyone, or tell anyone where to obtain them, through the game or any of our community spaces.
• Your ROM files are processed locally in your browser. They are never uploaded to our servers. The graphics and sounds built from them are stored in your browser’s storage on your device. If you tick “Remember these ROM files on this device”, the files are also kept in your browser on that device, and still never leave it.
• We cannot see or verify the files you use, so you alone are responsible for making sure your use of them is lawful.
• You may instead choose the optional “Modern” art and music set. If you do, your browser downloads those files directly from third-party sources, and your use of them is subject to those sources’ own terms.

6. Your account

• Use an email address that is yours and that you can access. Your email is your sign-in identifier and must be verified with a code we send to it.
• Each account is for one person. You must not share, sell, buy, lend, give away or otherwise transfer an account.
• Keep your password, the codes we email you and your recovery codes secret. We strongly recommend turning on two-factor sign-in with an authenticator app. Staff will never ask you for your password or codes.
• You are responsible for everything that happens on your account. If you think someone else has accessed it, change your password straight away and contact us.
• The number of accounts one person may hold is set out in the Player Rules, §3.

7. Player Rules

The Player Rules explain how to behave in the game and in our community spaces. They are part of these Terms: by accepting these Terms you also accept the Player Rules, and breaking them is a breach of these Terms.

8. Virtual items

• In-game money, Pokémon, items, badges, ratings and other things in the game (“virtual items”) exist only inside the game. They have no real-world value and cannot be exchanged for money or anything else outside the game.
• Virtual items are not your property. You receive a personal, revocable permission to use them in the game while your account exists.
• Buying, selling or trading virtual items or accounts for real money or anything of real-world value is forbidden (see Player Rules, §5).
• We may change, rebalance, remove or reset virtual items and game progress, for example to fix a bug, to undo the effects of a rule break, or as the game is developed. We are not obliged to compensate you for this.

9. Moderation and appeals

• Staff (game masters and administrators) look after the game. They may warn you, suspend your account for a period, or ban it permanently, and may remove Pokémon, items or in-game money gained by breaking the Player Rules.
• When an account is suspended, the suspension message states the reason and the rule that was broken.
• Some outcomes are automatic by design: for example, disconnecting in the middle of a battle against the game’s trainers counts as a loss, and the PvP ladder does not count very short matches or repeated wins against the same opponent within an hour.
• You can appeal a moderation decision by emailing legal@pokeroamers.com within 30 days. Include your trainer name and explain why you think the decision is wrong. A member of staff reviews the appeal, and the decision after that review is final.
• More detail is in the Player Rules, §9.

10. What you post

“Your content” means what you write or create in the game, such as your trainer name, the rival name you choose, Pokémon nicknames, box names, guild names, chat and voice messages, and bug reports.

• You keep whatever rights you have in your content.
• You give us a non-exclusive, royalty-free permission to store, copy, display and transmit your content only as needed to run, maintain and moderate the game. This permission ends when your content or your account is deleted, except for copies other players already hold. For example, a Pokémon you traded away keeps your trainer name as its original trainer.
• You must not post content that is illegal or that infringes anyone else’s rights, and your content must follow the Player Rules.
• We may remove or change content that breaks these Terms or the Player Rules.

11. Rights-holder and illegal content notices

If you believe something in the game infringes your rights, or is illegal, email legal@pokeroamers.com. Please tell us who you are, what the content is and where it appears (for example the trainer name, the in-game place and the time), and why you believe it is infringing or illegal. We review notices promptly and act on them, which can include removing content, restricting accounts or, where a rights holder asks, changing or withdrawing parts of the game.

12. The service

• PokeRoamers is a free hobby project provided “as is” and “as available”. It is a development build that is still changing, and it will contain bugs.
• We may change, add or remove features, take the game offline for maintenance, reset game data, or stop running PokeRoamers altogether, at any time and without prior notice.
• We do not promise that the game will always be available, free of errors, or that your progress will never be lost.

13. Liability

• To the extent permitted by law, the PokeRoamers team is not liable for any loss or damage arising from your use of, or inability to use, the game, including lost progress, lost virtual items, or problems caused by other players or by the ROM files you use.
• Nothing in these Terms excludes or limits liability for intentional misconduct or gross negligence, for death or personal injury, or for anything else that cannot be excluded or limited by law.
• Nothing in these Terms affects the mandatory rights you have as a consumer under the law that applies to you.

14. Ending your use

• You can stop playing at any time, and you can delete your account yourself in the game under ⚙ Settings → 👤 Account → “Delete account”. Deletion is immediate and permanent. What happens to your data is explained in the Privacy Policy.
• We may suspend or close your account if you break these Terms or the Player Rules, if we need to in order to comply with the law or a request from an authority, or in response to a request from a rights holder.
• If we stop running PokeRoamers, all accounts and game data will end.
• Sections that by their nature should continue after your account ends (such as sections 4, 8, 10, 13 and 16) continue to apply.

15. Changes to these Terms

We may update these Terms, for example when the game gains new features or the law changes. Each version is dated at the top of this page. We announce material changes in the game or on the site, and ask you to accept the new version the next time you sign in; if you do not accept it, you can no longer play, and you can delete your account. Previous versions are available on request.

16. Governing law

These Terms are governed by the laws of Greece. If you are a consumer living in the European Union, you also keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of that country.
